Terms of use

1. Agreement

These terms are between you and Fluctus Limited ("we", "us"), the developer of the Peptrend iOS application and this website (together, "Peptrend"). By downloading, installing or using Peptrend you agree to them. If you do not agree, do not use Peptrend.

Peptrend is distributed through Apple's App Store and your use is also subject to Apple's own terms. Where Apple's Licensed Application End User License Agreement applies, it applies in addition to these terms.

2. Peptrend is not medical software

Peptrend is a personal tracking tool. It does not provide medical advice, diagnosis or treatment, and it is not a medical device.

The circulating-dose figure is a simplified mathematical estimate based on published half-life values. It may differ substantially from the actual concentration of any substance in your body. Weight trends, projections, deficits and estimated finish dates are statistical estimates, not clinical measurements.

The reconstitution screen reports a concentration in mg/mL from the numbers you enter. It does not tell you what dose to take or what volume to draw, and you must not treat it as if it did.

You are solely responsible for all decisions about your health, including whether and how to use any medication or supplement. Consult a licensed healthcare provider before starting, stopping or changing any medication, dosage or weight management program. Never disregard professional medical advice because of something shown in Peptrend.

3. Eligibility

You must be at least 18 years old to use Peptrend. Peptrend is not directed at children.

4. Your data

Everything you log stays on your device and, if you leave iCloud on, in your own private iCloud database. We cannot read it, recover it or restore it. Keeping your own backups is your responsibility. See the privacy policy for the full picture.

5. Free features and Peptrend Pro

Logging weigh-ins and doses, your full history, the raw weight chart, import, export, Apple Health reading, iCloud sync and dose reminders are free and stay free.

Peptrend Pro unlocks the trend chart and the analysis built on it. It is offered as an auto-renewing monthly subscription, an auto-renewing yearly subscription, or a one-time lifetime purchase.

Subscription terms

  • Price and period. Peptrend Pro Monthly is US$12.99 per month. Peptrend Pro Yearly is US$69.99 per year. Prices in other regions are set by Apple's pricing tiers and are shown in the app before you buy.
  • Payment. Payment is charged to your Apple Account at confirmation of purchase.
  • Renewal. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the end of the current period.
  • Managing and cancelling. You can manage your subscription and turn off auto-renewal in your Apple Account settings after purchase. Cancelling stops the next renewal; it does not end the period you have already paid for.
  • Free trial. A 7-day free trial may be offered on either subscription if you have not previously used a trial in this subscription group. If you have a trial, it converts to a paid subscription at the end of the 7 days unless you cancel at least 24 hours before it ends. Any unused portion of a free trial is forfeited if you buy a subscription during the trial. The lifetime purchase is not a subscription and carries no trial.
  • Changing plans. The monthly and yearly subscriptions are in the same subscription group, so moving between them is a change of plan rather than a second purchase, prorated by Apple.

Lifetime purchase

The lifetime purchase is a one-time, non-consumable in-app purchase that unlocks Pro for as long as the app is available on your Apple Account. It does not renew and cannot be cancelled. "Lifetime" refers to the lifetime of the app, not of any person, and it does not guarantee that the app will be published indefinitely.

Refunds

All purchases are processed by Apple, and refunds are handled by Apple under its own policies. We cannot issue refunds directly. Request one at reportaproblem.apple.com.

6. Acceptable use

You agree not to:

  • reverse engineer, decompile or modify Peptrend except where that right cannot lawfully be restricted;
  • use Peptrend to provide medical advice or a clinical service to anyone else;
  • resell, sublicense or redistribute Peptrend or access to Peptrend Pro;
  • use Peptrend in any way that breaks the law where you are.

7. Intellectual property

Peptrend, its name, its interface and its source code belong to Fluctus Limited. You get a personal, non-transferable, revocable licence to use the app on devices you own or control. Your own logged data belongs to you.

8. Availability and changes

We may change, suspend or discontinue any part of Peptrend, including features, at any time. We may update these terms; material changes will be reflected in the effective date above, and continuing to use Peptrend after that constitutes acceptance.

9. Disclaimer of warranties

To the maximum extent permitted by law, Peptrend is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that Peptrend will be uninterrupted, error-free, or that any estimate it produces is correct.

10. Limitation of liability

To the maximum extent permitted by law, we accept no liability for any loss, injury or damage of any kind — including indirect, incidental, special, consequential or punitive damages, loss of data, or any harm to your health — arising from your use of, or reliance on, Peptrend or its estimates. Where liability cannot be excluded, it is limited to the amount you paid for Peptrend in the twelve months before the claim.

Some jurisdictions do not allow certain exclusions or limitations, so parts of the two sections above may not apply to you.

11. Apple

Apple is not a party to these terms and has no responsibility for Peptrend. Apple has no obligation to provide maintenance or support for Peptrend. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

12. Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules.
